This month’s column is an overview of PCTC’s Motion for Summary Judgement, filed in May.
The MoSJ asks to court to find in favor of PCTC, ordering USGS to release all documents requested via FOIA to the PCTC.
The filing also included USGS’s extraordinary – and inherently unscientific – response that its reason for not releasing all the information to PCTC is fear that PCTC will use the information to criticize the USGS. This is a jaw-dropping argument for a government agency to make! The heart of the scientific method is falsification – that is, to probe and test a hypotheses in an attempt to disprove it.
